ROCHE'S CHEMIST- ONLINE SHOPPING TERMS & CONDITIONS:
These online shopping terms and conditions (“On-line Shopping Terms and Conditions”) apply to all orders which you, the customer (“you” or “your”), place using this website “www.rocheschemist.ie and www.roches-chemist.com'' (“website”), operated by us, Brighton Healthcare Ltd(“we” “us” or “our”). Please read them carefully before placing your order and print a copy for future reference.
By using this website, you accept and agree to be bound to these on-line shopping terms and conditions, the privacy Statement and any other policies as we notify you of, from time to time, which together constitute the entire agreement between us.
Nothing in these on-line shopping terms and conditions affect your statutory rights, either as a consumer or otherwise.
We only sell items to adults (ie those aged 18 or over).
If you are under 18, you can use this website only with the involvement of a parent or guardian.
PRIVACY AND COMMUNICATIONS:
Ensuring the privacy and security of customers’ personal information is very important to us. Our privacy and security policy outline the information we collect about you, how and why the use of the information and the choices you have to restrict our usage of this information.
All data is treated with the utmost confidentiality. We do not share, rent or sell any of our customer’s information to any other individual, business or organization.
It fulfils our obligations to you under These On-line Shopping Terms and Conditions in that we communicate with you by e-mail and by posting notices on the Website. You agree to receive communications from us electronically and electronic communication that will satisfy any legal requirement for communication in writing.
THE CONTRACT BETWEEN US:
When you place an order using our website, this is an offer by us to you to buy those items. We will confirm receipt of your order by sending you an email SUMMARISING the details of your order (“Order Confirmation E-mail”). We accept your order only when we send an e-mail confirming that we have despatched the items in your order (“Despatch Confirmation E-mail”). The contract between us is formed at the point we send the Dispatch Confirmation E-mail in respect of those items mentioned in the Despatch Confirmation E-mail, whether or not you receive this email. If your order contained a number of items and the Despatch Confirmation E-mail mentions only some of them, those items that have yet to be despatched to you do not form part of that contract.
The purchasing of the goods that we sell on this website is a dynamic process and prices from manufacturers do change. With small variations in price, we will normally dispatch the goods but if there are large price increases ( >10% ) from manufacturers, we reserve the right to cancel the order and refund the money the customer has paid. Orders placed on Fridays will not be delivered until after the weekend as our courier ( DPD ) does not deliver at weekends. All products are subject to availability and delays in delivery may sometimes occur.
Products are invoiced in Euro at the price prevailing at the time you place your order and include VAT where applicable. Orders from the UK will be invoiced in UK Pounds ( Sterling ) using the conversion rate from Euro relevant at the time of ordering.
Delivery Charges: Will be based on the weight / dimensional weight of the consignment and the cost of postage with DPD couriers ( Part of the French Service - La Post ) . All deliveries come with tracking and there are specific exclusions. The prices quoted are only for mainland Europe - ISLANDS OFF THE COAST OF A COUNTRY ARE SPECIFICALLY EXCLUDED.
For example: In the UK: The Scottish Islands, Scilly, Jersey, Guernsey, Orkney, Hebrides, Isle of Man or BFPO are not included
For Spain: Islands in the Balearics or other islands off the coast in Spain are not included.
The same holds true for other island entities off the coast of all other countries that we deliver to.
Excluded destinations also include: Andorra, Faroe Islands, Greenland, Aland, Corsica, Guadeloupe, Martinique, La Reunion, Franz, French Guyana, St Pierre & Miqulon, Mayotte, New Caledonia, French Polynesia, Wallis and Futuna, Madeira, Azores, San Marino, Sardinia, Livignio, Melilla & Ceuta as well as the previously mentioned Balearic Islands, Canary Islands
Deliveries to Excluded destinations MAY be possible by contacting us and paying the extra surcharge.
Although we try to ensure that all prices on the website are accurate, errors can and will occur.
If we discover an error in the price of items you have ordered, we will contact you as soon as possible. You will have the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled.
Displayed prices on the Website apply to online purchases only. They are not indicative of the price of identical items purchased in our store or by any other means. We reserve the right to update prices displayed on the website from time to time.
We accept the following methods of payment: Visa, MasterCard & debit cards through our Opayo payment gateway. We also accept payment securely through PayPal.
Prices are usually quoted in Euro, in Sterling for the UK and in US Dollars for some destinations. You can use your credit card, the credit card provider will calculate the relevant exchange rate automatically.
If you live in the European Union you have the right by law to withdraw from the purchase of an item within the “cooling-off” period of seven working days starting on the day after the day the item is delivered to you (“Cooling- Off Period ‘). This right applies to almost all items advertised on the website. The exceptions to this are for baby formula / Baby Teats or intimate products which we cannot accept in the interests of patient safety / hygeine.

RETURNS and REFUNDS:
We are happy to accept returns within 7 days of the order. Just email us at email@example.com. If we have already dispatched the order, it needs to be returned to use at Roche's Chemist, 34 Vevay Road, Bray, Co Wicklow, Ireland A98 D9X2 before a refund can be applied. Once we receive the goods in original packing and condition, we will process the refund.
Once you request to cancel your order / return an item within 7 days following receipt of delivery and we receive the returned item within 10 days of your nitification of cancellation / return, we are happy to provide a refund provided that the products are unopened, unused and in the original packaging. Please allow up to 7 days for refunds to show up in your account, from the date we receive your return. We will refund you by the same method the original payment was received ( eg. A credit Card payment payment will be refunded back to the same card or to the same Paypal account ) Please note that the speed the refund reaches your account will depends on your bank and not on Roche's Chemist.
Plase NOTE: There are some items that cannot be returned: To include but not limited to: Baby Formula/ Sterile teats / Intimate Products
ITEMS DAMAGED IN TRANSIT:
If you take delivery of a package from us and the contents have been damaged in transit, we will exchange the damaged items without charge to you provided you return the damaged item (s) to us within 30 days of taking delivery.
If we have sent you an incorrect item, please notify us as soon as possible and return the incorrect item to us and specify the correct details in writing. If you would like us to replace the incorrect item with the correct item, we will send you the correct item as soon as possible. We will not charge you for the incorrect item and will reimburse your reasonable costs in returning it.
We will reimburse any reasonable costs you incur in returning the items to us if:
- the items were delivered to you in error;
- the items were damaged upon delivery or are defective or incorrect;
You will be responsible for the costs of returning items to us in all other circumstances, (Including if you exercise your right to withdraw your purchase in the Cooling-Off Period).
You are also responsible for giving us your correct delivery address. If the address you give or is incorrect or incomplete and your order is undeliverable, we will do our best to contact you to obtain the correct details by either phone or email. If we cannot contact you or you do not reply within 10 days with the corrected details, the courier ( DPD ) will regard the item as permanently undeliverable and we will not be in a position to give a refund for the order.
LIMITATION OF LIABILITY:
To the fullest extent of the applicable law, under no circumstances, including, but not limited to, negligence, shall we be liable to you for any direct, indirect, incidental, special or consquential damages that result from the use of or the inability to use the website, any changes to the website, any material or data sent or received or not sent or received or for any of the above-mentioned damages that result from the use or the inability to use the products. In no circumstances shall our liability and that of our suppliers to you and/or any third parties for any of the above exceed €250.
ALTERATIONS TO THIS WEBSITE AND TERMS AND CONDITIONS:
We reserve the right at any time to make changes to this website, these On-line Shopping Terms and Conditions, Privacy Statement and any other policies as we may notify you of. You will be subject to the policies and terms and conditions in force at the time you use the website or order items from the website. Which changes we are required to make by law could apply to orders which you have already made. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, it will be deemed severable and not: affect the validity and enforceability of the remaining terms and conditions.
If you breach these On-line Shopping Terms and Conditions and we take no action, we will still be entitled to use our rights and remedies in other situations where you are in breach.
RECYCLING OF ELECTRICAL ITEMS:
Roche's Chemist will take back your WEEE on a one-for-one, like-for-like basis, free of charge at the time of delivery or at any one of our store(s) nationwide. Waste batteries are taken back in store on a one-forzero basis (i.e. no purchased required) as long as they are of equivalent type to that sold by us. WEEE and waste batteries can also be returned to your local civic amenity site free of charge. Never put WEEE, batteries or light bulbs in any of your bins.
WEBSITE IMAGES:Roche's Chemist has made every effort to reproduce colours and images on our website as accurately as possible. However, different devices reproduce colours in slightly different ways, this means that the colours of products and packaging dispatched may differ from what you see on the screen. Also suppliers and manufactures are constantly changing and upgrading their packaging often with a view to reducing secondary packaging and making all packaging more recyclable. This is something we have no control over and in fact we welcome. This means that the type and colour of packaging dispatched may differ from what you see on the screen.
GOVERNING LAW AND JURISDICTION:
These On-line Shopping Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Ireland. You agree to submit to the non-exclusive jurisdiction of the Irish courts, as do we.
